Back in 2006, the Florida Supreme court ruled that the state's smokers couldn't sue tobacco companies as a class.
２００６年にフロリダ州最高裁判所は同州の喫煙者はたばこ会社を集団訴訟で提訴することは出来ないとしました。
However, it left 4,000 plaintiffs eligibleto try their claims individually-and one of them just won a cool $300 million.
しかし、まだ４０００人の喫煙者には個人的に訴訟を起こす道が残されており、その一人が３億ドルという大金を訴訟で勝ち取りました。
On Nov. 19 a Florida jury ruled against Philip Morris USA and awarded $56 million in compensatory damages and $244 million in punitive damages for the illness of longtime smoker Lucinda Naugle.
１１月１９日にフロリダ陪審はフィリップモリスに対し、原告ルシンダ　ノーグルの喫煙からきた病気に対して５６００万ドルの損害賠償と、２億４４００万ドルの懲罰的損害賠償の評決をしました。

The company will appeal the verdict, which one of its lawyers termed in a statement "glossly excessive" and "the result of numerous erroneous rulings."

会社は評決に対し、異議申し立てをする予定です。弁護団の一人は声明を発表して、「評決は過大に過ぎ、多くの事実誤認に基ずくものである」と述べた。

まだ続くたばこの損害賠償訴訟、懲罰的損害賠償は、日本では憲法違反らしいです。
上級審では、事実関係は争われないで、法律判断、適用法についての解釈が争われるようです。
アメリカでの陪審員裁判の比率は全体の５％程度らしい。

また、刑事事件では一審で無罪（not guilty)になると、検察は上告できないそうです。日本の制度との大きな違いの一つです。Common　law　システムと言うらしい。

How trustworthy are PC repair technicians? Looking for possible ripoffs, British TV's Sky News and PC Pro magazine created a simple problem in a notebook by loosening a memory chip.
PC修理技術者は信用できるのか？不正の可能性を調査するため英国のスカイニューステレビと雑誌PCプロが共同で、ノートパソコンのメモリーを緩め、不具合を起こしたＰＣを用意しました。

Then they took the computer-loaded with fake files and software that could track what technicians did-to six London repair outlets.
これらのパソコンに、偽のファイルと操作履歴の追跡ソフトを組込、６カ所の修理店に、修理依頼をしました。

All the shops quickly discovered dislodged chip, with five of them dishonestly telling the "customer" that extensive repairs were neccessary.
どのお店も、簡単に、外れかけていたチップを発見しましたが、そのうち５店は、追加修理が必要であると、虚偽の話を”顧客”に伝えました。
At two of those shops technician also looked through "vacation photos" the notebook contained(pictures of the customer clad in a bikini).
２つのお店では、ノートパソコンに入っているビキニ姿の休暇写真にアクセスしました。
One tried to cover his tracks. The other copied the snapshots to his USB drive. He also tried to log into a faux online bank account planted on the laptop.(He was reported to the police.)
一店は、履歴を消去しようとしました。また他の店は、ＰＣに記録してあった偽の銀行口座にログインしようと試みました。（警察に連絡されました）

And the shop that passed the ethics test? Let's hear it for Pix 4 in Shepherd Bush. Wrote PC Pro:"the staff promptly discovered the loose chip, popped it back into place, and told us with smile there woould be no charge."
問題の無かったお店はと言いますと、（シェファードブッシュのpix４の為聞いてみましょう）
そこでは、技術者は即座に不具合を探し出し、きちんと差し込んで、笑顔で、”修理代は無料です”と答えたそうです。

"Let's hear it for Pix 4 in Shepherd Bush."の部分が分かりません。

The Middle Kigdom's trade numbers for December were lousy, but January's turned out to be downright shocking.
中国の12月の貿易統計はひどいものでしたが、１月は更に悪化しております。
Exports last month plummeted 17% from a year earlier, while imports fell off a cliff, down 43.1%.
先月の輸出は前年同期比１７％マイナスでしたが、輸入に至っては４３．１％ものマイナスでした。
That indicate economic growth is stalling despite Beigin's outsized stimulus spending.
And that, in turn, is discouraging news for law materials producers everywhere, who banked on china to keep demand cooking.
これは北京政府の大型経済刺激策にもかかわらず、経済成長は停滞していると言うことです。これは中国の需要に頼ってきた資源生産者（国）にとっては、大変ショッキングなことです。

ビジネスウィークからの記事ですが、これが事実であると、中国の経済成長もマイナス成長になると思われますし、日本の大幅ＧＤＰマイナス成長も、中国の経済停滞に起因するところが大きいかもしれません。

果たして、中国のＧＤＰ等の統計は信頼に値するのでしょうか？

オバマの就任演説

オバマの就任演説を聴いてみました。


My fellow citizens:
I stand here today humbled by the task before us, grateful for the trust you have bestowed, mindful of the sacrifices borne by our ancestors. I thank President Bush for his service to our nation, as well as the generosity and cooperation he has shown throughout this transition.


これが始まりです。

一つ一つの文章は、平易で、格調高い印象です。トランスクリプトを読んで、それから聞いてみました。

印象は、

感動がない、まるで、すばらしい言葉のパラフレーズ集みたいな印象でした。ケネディーやリンカーンの言葉をそのまま使ってはいませんが、そっくりパラフレーズしてある。

イラクからの撤退を明言した事くらいで、何か元気がない印象、達成感に満足してしまった人の演説みたいに聞こえました。
言葉がむなしく流れていきます。
